1.1 Farmer's Choice Free Range Limited ("Farmer's Choice") shall deliver to the Customer the pack(s) chosen by the Customer from the current brochure of Farmer's Choice as stated in each order.
1.2 The pack(s) shall be delivered on the delivery date(s) stated in the order provided that Farmers Choice has received cleared funds for the first payment.
2.1 The price for the pack(s) shall be as stated in the order and payment shall be made in monthly instalments in accordance with the Bankers Standing Order completed by the Customer.
2.2 The price for the pack(s) shall be in accordance with the price list of Farmer's Choice current at the date of the agreement containing the first order by the Customer ("the Agreement") and shall apply to all pack(s) ordered during a period of 12 months from that date.
2.3 The price of pack(s) ordered during the subsequent 12 months shall be in accordance with the price list of Farmer's Choice current at the date of commencement of that next twelve month period with annual changes on the anniversary of the Agreement until its termination in accordance with clause 4.
3. Farmer's Choice shall be under no obligation to deliver any pack(s) unless the following conditions shall have been fulfilled:-
3.1 The Customer shall have given at least 2 weeks notice to Farmer's Choice of the Customer's requirement for delivery of the items ordered.
3.2 The Customer shall have paid to Farmer's Choice under the provision above the whole of the cost of the pack(s) already delivered.
4. The Agreement between Farmer's Choice and the Customer may be terminated as follows:-
4.1 By the Customer in writing to Farmer's Choice at any time but upon such termination other than termination within seven days of the date of the Agreemant the following conditions shall apply:- 4.1.1 The Customer shall forthwith pay Farmer's Choice any unpaid balance in respect of the pack(s) already delivered.
4.1.2 If the Customer shall terminate the Agreement after having given notice requiring delivery of the next pack(s) but before receiving delivery then Farmer's Choice shall be entitled to retain or recover by way of compensation one monthly payment of the price of the pack(s)
4.13 If the Customer shall have made any payment to Farmer's Choice prior to termination of the Agreement and shall not have received pack(s) to the value of it, then upon termination of the Agreement the Customer shall not be entitled to a refund of such payment but shall accept pack(s) to the value of it.
4.2 By Farmer's Choice in writing to the Customer at any time if:-
4.2.1 Any cheque paid by the Customer to Farmer's Choice shall not be paid on presentation or
4.2.2 Any payment to Farmer's Choice by debit or credit card is refused by the card provider or
4.2.3 the Customer shall cancel the Standing Order in favour of Farmers Choice or
4.2.4 the Customer's bank shall for any reason fail to pay Farmer's Choice in accordance with the Standing Order.
5. This Contract is subject to the Law of England and Wales
